Smoke Alarms
Landlords:
As a landlord you have a duty of care to your tenants across a number of areas. One of these legislated requirements is the installation and maintenance of smoke alarms in your investment property. These alarms need to meet the requirements of the Building Code of Australia, Environmental Planning and Assessment Act & the Residential Tenancies Act. It's to be noted that the legislation has been in for 10 plus years now meaning a lot of alarms are now moving beyond their 10 year expiry date. With daylight savings coming to an end it is always a timely reminder to change smoke alarm batteries and also a good time for us to talk to you about smoke alarms and compliance. Whilst we endeavour to check all smoke alarms are in place at every inspection, we are unable to check expiration dates and when batteries have been last replaced. With the upcoming Tenancy Legislation review they are looking at changing the current law with regards to Smoke Alarms, at this stage the owner is legally required to make the smoke alarm compliant at the start of each tenancy and the tenants are then responsible for changing batteries whilst at the property, but they are looking to change this back to being an owners responsibility to maintain all the time.
