'We', 'us' or 'our' refers to Doyle Spillane Pty Ltd (ABN 77 002 136 469) of 761 Pittwater Road, Dee Why, NSW, 2099, including its associated entities as defined in Corporations Act 2001 (Cth) s 50AAA.

As a long-established property agency on Sydney's northern beaches with an excellent reputation for professionalism and customer service, we are committed to observing our obligations under the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs) thereunder to ensure that personal information is handled fairly, securely and transparently.

This Privacy Policy is made freely available to you to inform you of when, how and why we handle personal information.

By using or accessing our website and services, you signify your agreement to be bound by this Privacy Policy.

Types of Personal Information We Collect

We collect and hold personal information relating to our clients and to third parties and entities associated with our clients as may be provided or disclosed to us in the ordinary course of operating a property agency business. Such personal information may include, but is not limited to, names, tax file numbers, addresses, telephone numbers, social media details, email addresses, occupations, wage records, bank account details, asset and investment details, financial planning records, taxation records, medical records and relationship details.

How Personal Information is Collected and Held

Your personal information is collected by us by:

  • you providing it to us directly;
  • you authorising third parties to provide it to us;
  • by other parties providing it to us either voluntarily or pursuant to compulsory processes we conduct on our client's behalf.

Personal information may be received and held either as a hard copy, paper, or a soft copy being electronic data, in any available form. In all instances, we take the security of personal information very seriously.

We secure hard copy documents carefully onsite and offsite. We use cyber-security systems to protect soft copy documents and limit exchange of bank details or sensitive information via email as far as is reasonably practicable considering the nature of our business.

Purpose for Collection, Holding, Use and Disclosure of Personal Information

All personal information is processed by us on a lawful basis. The purposes for which we collect, hold, use and disclose personal information include:

  • to offer our property agency services to our clients including the sale and purchase of properties and receiving tenancy applications for and leasing properties. In doing so we may disclose personal information to other people or entities involved in the provision goods or services, such as government departments, third party institutions such as banks and professional services practices, and individuals. Unless compelled by law, we will never disclose personal information without your knowledge and consent;
  • to facilitate our internal and external administrative processes including financial and business operations and reporting requirements;
  • to communicate with you, including ongoing marketing communications which you opt to receive;
  • to obtain professional advice regarding our business and services;
  • to obtain, maintain and comply with the terms of our professional indemnity and other insurance policies; and
  • to comply with applicable laws.

We handle personal information as necessary for our business functions to provide property agency services to you. If you do not provide your personal information, we may not be able to provide you with assistance, services or information you have requested.

Accessing and Correcting Personal Information

You will be subject to formal verification of identity before we can release or amend any personal information.

Within 30 days from completion of your formal verification of identity, we will provide you with access to your personal information or correct your personal information.

Personal Information Disclosure Outside Australia

While the majority of our staff are based in Australia, we have a small number of offshore staff based in the Philippines who may from time-to-time, access your personal information in the course of providing our services.

As an Australian-owned and based company, disclosure of personal information to overseas recipients is generally limited, but may occur as required from time to time if we are dealing with customers or third parties in property transactions who are based overseas such as vendors, purchasers, landlords and tenants. To that extent, we may disclose personal information to any overseas jurisdiction where a party is based, as is reasonably necessary in providing our services. The likely countries where disclosure of personal information may occur include China, the European Union jurisdiction, Hong Kong, Japan, Malaysia, New Zealand, Singapore, the United Kingdom and the United States.

Complaint Handling

If there is a breach of this Privacy Policy, the Privacy Act or the APPs, you may make a complaint to:

Within a reasonable time from receiving your complaint and by no later than 30 days, we will investigate your complaint and provide a written response.
  • The Office of the Australian Privacy Commissioner at https://www.oaic.gov.au/privacy/privacy-complaints/lodge-a-privacy-complaint-with-us or 1300 363 992. The OAIC will consider your complaint and if it determines to proceed, will investigate your complaint including by writing to us, and will endeavour to resolve your complaint.

Changes to Privacy Policy

We may from time-to-time update, amend and otherwise revise this privacy policy which will remain available and accessible to third parties, including on our website. Your continued use of our services will constitute your acceptance of any revised privacy policy.
